Article 24 (Special Cases on Issuance of Stocks by Former Venture Business)(1) Even where a venture business which falls under any of the following subparagraphs is no longer recognized as such, it shall be deemed a venture business with regard to the application of the provisions of Articles 10-2 and 16-3 above:  <Amended by Act No. 5607, Dec. 30, 1998; Act No. 6416, Feb. 3, 2001>

1. A venture business which is established with capital of less than fifty million won under Article 10-2;

2. Deleted; and  <by Act No. 6416, Feb. 3, 2001>

3. A venture business which grants a stock option under Article 16-3.

(2) Even where a venture business, which has moved into an exclusive complex for venture businesses or collective accommodation of venture businesses, is no longer recognized as such, it may remain there.

Article 25 (Confirmation as to Whether Venture Business or not)(1) An enterprise may request the Administrator of the Small and Medium Business Administration to make confirmation as to whether it may be categorized as a venture business or not.  <Amended by Act No. 5529, Feb. 28, 1998>

(2) In the event of a request made to the Administrator of the Small and Medium Business Administration in accordance with the provisions of paragraph (1), the Administrator shall make confirmation within the time-limit as prescribed in the Ordinance of the Ministry of Commerce, Industry and Energy, and give notice on the result of such request of the inquiring person.  <Amended by Act No. 5529, Feb. 28, 1998>

(3) Matters necessary for procedures of requests for confirmation, for confirmation itself, etc. in accordance with the provisions of paragraphs (1) and (2) shall be prescribed by the Ordinance of the Ministry of Commerce, Industry and Energy.  <Amended by Act No. 5529, Feb. 28, 1998>

Article 26 (Report, etc.)(1) The Administrator of the Small and Medium Business Administration, if he regards it necessary for the implementation of this Act, may request the Investment Company or the Investment Association to submit reports on actual results of investment.  <Amended by Act No. 5529, Feb. 28, 1998>

(2) The Administrator of the Small and Medium Business Administration may each year request the Venture Business Investment Association or the Financing Business for New Technology Projects to submit materials relating to the current state of participation into holding shares of businesses into which it has made investment.  <Amended by Act No. 5529, Feb. 28, 1998>

(3) The Administrator of the Small and Medium Business Administration, if he regards it necessary for the implementation of this Act, may require an individual or the private investment association in pursuance of the provisions of Article 14 (2) above to submit reports on actual results of investment.  <Amended by Act No. 5529, Feb. 28, 1998; Act No. 6416, Feb. 3, 2001>

Article 27 (Mandate or Entrustment of Authority)

Some of the authority of the Administrator of the Small and Medium Business Administration according to this Act, subject to the Presidential Decree, may be delegated to the head of entities or institutions under his control or to the Mayor/Do governor, or may be entrusted to the head of other administrative entities, or establishments or associations relating to small businesses as prescribed in the Presidential Decree.  <Amended by Act No. 5529, Feb. 28, 1998>

This Act shall enter into force on the date of its promulgation.

(1) (Enforcement Date) This Act shall enter into force on May 1, 2001.

(2) (Application Examples to Private Investment Association) The amendments to Article 13 shall be applicable from the private investment association to be registered to the Administrator of the Small and Medium Business Administration for the first time after the enforcement of this Act.
